Deen Kaplan practices in the areas of international trade law and policy, customs/homeland security law, immigration law, and international arbitration. He represents a broad range of clients before U.S. federal agencies that regulate international trade matters, including the Department of Commerce, International Trade Commission, Trade Representative's office, and Customs and Border Protection. Deen also represents clients in several international fora, including dispute settlement proceedings before the World Trade Organization (WTO), NAFTA disputes, and trade-related bilateral and multilateral negotiations. Deen’s areas of concentration include countervailing and antidumping duty litigation, WTO policy and dispute resolution, subsidy law policy, security and trade, trade in technology products, and trade sector analysis.
Deen also brings to bear nearly a decade’s worth of practical experience in the business and nonprofit sectors, including service as an executive in computer hardware, software development, and consulting businesses.
Deen is the associate editor of the Kluwer Law International ITA Monthly Report, an international arbitration law journal published in association with the Institute for Transnational Arbitration. He also lectures regularly on international trade issues and teaches international trade law at the University of Maryland School of Law as a member of the adjunct faculty. The 2007 edition of Chambers USA lauds Deen as "unbelievably smart," noting his role in one of the world's largest trade disputes and his capacity to "blow clients away" with his work.
Representative Experience
Represent the Government of the Province of Ontario in the world’s largest countervailing duty dispute, Softwood Lumber from Canada, which includes multiple proceedings before U.S. administrative agencies, concurrent litigation before NAFTA appellate panels, and counsel for related WTO proceedings. Provide policy counsel regarding possible Canada-U.S. agreements on lumber trade.
Successfully assisted a government and several companies in achieving a major WTO decision rejecting the practice of imposing countervailing duties on unsubsidized private companies. The practice was subsequently revoked, and the applicable duties for our clients were substantially reduced.
Successfully represented clients in U.S. trade remedy proceedings involving stainless steel plate and sheet and strip products from various countries. Our client’s trade remedies liability was significantly reduced through effective advocacy in several administrative and appellate fora.
