Hogan & Hartson provides strategic counseling to companies seeking to develop and manage their intellectual property (IP) portfolios to achieve critical business objectives. Many of our attorneys bring substantive business experience in the IP-driven industries related to their areas of legal experience. They understand the practical considerations their clients face in maximizing the value of an IP portfolio. We have the ability to offer strategic counseling in all aspects of intellectual property, including patents, trademarks, copyrights, and IP licensing. Our United States, European, and Asian offices include attorneys with practical local experience in how best to develop and use IP assets in a particular country and region.
We work with a wide variety of national and international clients on their strategic IP objectives. Our attorneys bring seasoned legal and business experience to a wide variety of IP-intensive enterprises, including computer software and semiconductor companies, medical device and biotechnology companies, and entertainment and broadcast media companies. We regularly conduct IP audits for our clients to evaluate their IP portfolios, recommending where a portfolio should be bolstered and where it can be made more cost-efficient. We also advise clients on the strength and value of IP assets in the context of mergers, acquisitions, IP asset sales, and strategic licensing agreements.
Our attorneys have assisted major electronics software and manufacturing companies in both defensive and offensive licensing discussions with their competitors. Our attorneys work with technical experts to establish non-infringement and invalidity positions with regard to their competitors’ patents while demonstrating and documenting a competitor’s infringement of our clients’ patents. We assist in facilitating or leading licensing discussions in addition to working with trial counsel should licensing discussions not lead to an amicable conclusion.
